What personal data is processed, and for what purpose?

The following data is processed in the LIVO Technologies HelpDesk:

  • User account name (username)
  • User's email address
  • User's first and last name
  • User photo (optional)
  • The browser and, if applicable, the operating system of the computer used to access the site, as well as the name of the Internet service provider
  • IP address of the requesting system
  • User session and activities
  • Error messages and log files.

The data is processed for the following purposes:

  • Exchange of information between system users and LIVO Technologies GmbH—for example, for communication within tickets and between support staff.
  • Traceability of processing steps and the personnel involved in chronological order—this is important for tracking the process history and assigning responsibility.
  • Ensuring a comfortable user experience—for example, by optimizing the user interface and fixing bugs based on the user data collected.
  • Analysis of system security and stability, processing time, key topics, usage frequency, response times, etc. – this involves analyzing system performance to continuously improve efficiency and user-friendliness.
  • Notification of users by LIVO Technologies GmbH in the event of disruptions or data breaches – this is necessary to quickly inform users in the event of security incidents or data breaches.
  • System administration and ensuring system functionality —this includes managing user accounts and permissions, as well as system maintenance and updates.

If the system allows for optional entries, the user provides this information on an expressly voluntary basis.

What is the legal basis for the processing of personal data?

Data processing is carried out pursuant to Article 6(1)(b) of the GDPR (performance of a contract) and Article 6(1)(f) (legitimate interests).

Under no circumstances do we use the collected data to identify specific individuals.

Where is personal data processed?

The LIVO Technologies Helpdesk is based on the Jira Service Management module from Atlassian.
Data is processed in the Atlassian Cloud.

How long is personal data processed, and when is it deleted?

Personal data remains stored in the LIVO Technologies HelpDesk until

  1. a user requests the deletion of their account at
    or
  2. The business relationship with the customer (company) of LIVO Technologies GmbH has ended.

If, for technical reasons, it is not possible to delete the user account, the personal data will be anonymized.

Note: For legal reasons, it may be necessary to retain data even after the business relationship has ended. In such cases, the data will be deleted once the legally required minimum retention period has expired.

 

To whom is personal data disclosed?

Data will not be disclosed to third parties (other than Atlassian; see the section titled “Atlassian Cloud (including Jira and Confluence)”) without the user’s express consent.

We expressly point out that the transmission of data over the Internet (e.g., via email) may involve security risks.

Atlassian Cloud (including Jira and Confluence)

For the internal management, processing, and storage of information and data, we use the Atlassian Cloud (Atlassian Inc. (San Francisco, Harrison Street Location), 1098 Harrison Street, San Francisco, California 94103, USA) as well as third-party tools from the Atlassian Marketplace. The primary tools used are the Atlassian products Confluence, Jira, and Jira Service Management.

Atlassian offers a range of compliance features, such as SOC 2, PCI DSS, and ISO 27001/27018. Data is transmitted and stored in encrypted form. The existing certifications cover many of the security and data protection requirements of the GDPR. To ensure compliance with the GDPR, a Data Processing Addendum has been established with the provider, which explicitly includes the EU’s Standard Contractual Clauses (SCCs). The agreement is binding on Atlassian and enables LIVO Technologies GmbH to use the Atlassian Cloud in compliance with the GDPR.

Data from Atlassian Cloud may be stored in various regions around the world.
Where technically feasible, data is stored in the following regions in the order of priority listed below:

  1. Germany
  2. Ireland (EU)
  3. United States of America
  4. Other

In early March 2021, Atlassian announced that data belonging to European customers (such as LIVO Technologies GmbH) will be stored on servers within the EU starting in the second half of 2021.

8. Audio and Video Conferences

Data Processing

We use online conferencing tools, among other methods, to communicate with our customers. The specific tools we use are listed below. When you communicate with us via video or audio conference over the internet, your personal data is collected and processed by us and by the provider of the respective conferencing tool.

The conferencing tools collect all data that you provide or use in connection with the tools (email address and/or phone number). In addition, the conferencing tools process the duration of the conference, the start and end times of your participation in the conference, the number of participants, and other “contextual information” related to the communication process (metadata).

In addition, the tool provider processes all technical data necessary for handling online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or speaker, and the type of connection.

If content is exchanged, uploaded, or otherwise made available within the tool, it is also stored on the tool provider’s servers. Such content includes, in particular, cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards, and other information shared while using the service.

Please note that we do not have full control over the data processing activities of the tools we use. Our ability to influence these activities depends largely on the corporate policies of the respective providers. For further information on data processing by the conference tools, please refer to the privacy policies of the respective tools, which we have listed below.

Purpose and Legal Basis

The conference tools are used to communicate with prospective or existing contractual partners or to offer specific services to our customers (Art. 6(1)(b) GDPR). Furthermore, the use of these tools serves to generally simplify and expedite communication with us or our company (legitimate interest within the meaning of Art. 6(1)(f) GDPR). Where consent has been requested, the use of the relevant tools is based on this consent; consent may be revoked at any time with future effect.

Retention period

Data that we collect directly through our video and conferencing tools will be deleted from our systems as soon as you request that we delete it, revoke your consent to its storage, or the purpose for storing the data no longer applies. Stored cookies remain on your device until you delete them. Mandatory legal retention periods remain unaffected.

9. Our Own Services

Handling of Applicant Data

We offer you the opportunity to apply for a position with us (e.g., by email, mail, or via our online application form). Below, we provide information about the scope, purpose, and use of the personal data collected from you during the application process. We assure you that the collection, processing, and use of your data are carried out in accordance with applicable data protection laws and all other legal provisions, and that your data will be treated as strictly confidential.

Scope and Purpose of Data Collection

When you submit an application to us, we process the associated personal data (e.g., contact and communication details, application documents, notes taken during interviews, etc.) to the extent necessary to decide whether to establish an employment relationship. The legal basis for this is Section 26 of the German Federal Data Protection Act (BDSG) (initiation of an employment relationship), Article 6(1)(b) of the GDPR (general contract initiation), and—provided you have given your consent—Article 6(1)(a) of the GDPR. Consent may be revoked at any time. Your personal data will be shared within our company exclusively with persons involved in processing your application.

If your application is successful, the data you have submitted will be stored in our data processing systems in accordance with Section 26 of the German Federal Data Protection Act (BDSG) and Article 6(1)(b) of the General Data Protection Regulation (GDPR) for the purpose of administering the employment relationship.

Data retention period

If we are unable to offer you a position, if you decline a job offer, or if you withdraw your application, we reserve the right to retain the data you have provided for up to 6 months from the conclusion of the application process (rejection or withdrawal of the application) based on our legitimate interests (Art. 6(1)(f) GDPR). The data will then be deleted and the physical application documents destroyed. The retention serves, in particular, as evidence in the event of a legal dispute. If it becomes apparent that the data will be required after the 6-month period has expired (e.g., due to an impending or pending legal dispute), deletion will not take place until the purpose for continued retention no longer applies.

Data may also be retained for a longer period if you have provided the necessary consent (Art. 6(1)(a) GDPR) or if statutory retention requirements prevent its deletion.

Inclusion in the candidate pool

If we do not offer you a position, we may add you to our applicant pool. If we do add you, all documents and information from your application will be transferred to the applicant pool so that we can contact you if suitable openings arise.

Inclusion in the applicant pool is based solely on your explicit consent (Art. 6(1)(a) GDPR). Providing consent is voluntary and has no bearing on the ongoing application process. The data subject may withdraw their consent at any time. In this case, the data will be permanently deleted from the applicant pool, provided there are no legal grounds for retention.

Data from the applicant pool will be permanently deleted no later than two years after consent is given.
